1. Introduction
At TIBA and Nusantara Tiba Sdn. Bhd. (collectively, "we", "our", "us"), we provide an educational platform where subscribed users create rooms to share knowledge, publish educational content, and promote their services through listings or ad space. By using TIBA (including tiba.my, mobile apps, or APIs), you agree to these Terms of Use ("Terms of Use"), our Privacy Policy, and our Community Guidelines. Please read them carefully.
2. Account Responsibilities
- Subscribed Users: If you subscribe to a room, you gain the ability to publish educational content (e.g., tutorials, knowledge-sharing posts, threads, business listings, or ads). You are responsible for ensuring your content complies with our Community Guidelines and applicable laws, delivering promised educational benefits, and handling inquiries from users in your room.
- Non-Subscribed Users: If you join another user's room without subscribing, you cannot publish content. You are responsible for your conduct, including interactions in threads, forums, or other features, and agree not to share, distribute, or misuse other users' content without permission.
- Account Security: You are responsible for maintaining the confidentiality of your account credentials and reporting any unauthorized use promptly.
3. Content and Licensing
- By posting educational content on TIBA (e.g., tutorials, knowledge-sharing posts, threads, or media), subscribed users grant us a royalty-free, perpetual, non-exclusive, worldwide license to use, host, store, reproduce, distribute, and display your content to operate our services, promote your rooms, and enable features like comments or threads. This license does not transfer ownership of your content. You confirm that you have the rights to share any content you post and that it complies with our Community Guidelines.
4. Subscriptions, Payments, and Cancellation Policy
- Subscribed Users: By subscribing to a room, you gain the ability to publish educational content (e.g., tutorials, courses, or resources) and access ad space or business listings to promote your services. We charge a commission on your earnings, as detailed in the Pricing section on our website (tiba.my). You must provide a valid bank account for payouts, subject to our third-party payment provider’s terms.
- Non-Subscribed Users: You may pay subscription fees to access rooms created by subscribed users, which include educational content such as courses, workshops, or resources. Payments are processed through third-party providers (e.g., Stripe).
- Negative Balances: If refunds or chargebacks result in a negative balance in your account, we may recover these funds from future payments or withhold payouts until the balance is cleared.
- Cancellation Period: Subscribed and non-subscribed users may cancel their room subscriptions, course enrollments, or workshop registrations within 24 hours of registration without penalty. Cancellations must be submitted through the TIBA platform’s account management portal or by contacting our customer service team at tiba@tiba.my.
- Cancellation Fees: If cancellation occurs more than 24 hours after registration, a cancellation fee of 20% of the total subscription, course, or workshop cost will be charged to cover administrative and operational expenses.
- Refund Eligibility: Refunds are available for cancellations made within the 24-hour cancellation period or in cases of fraud or billing errors. Refunds will be processed within 5-7 business days and credited to the original payment method. Due to the digital nature of educational content (e.g., access to tutorials, courses, or resources), refunds for partial participation (e.g., attending some course sessions) are not available unless explicitly stated in the course or room description.
- Non-Refundable Services: Certain services, such as one-time webinars, live-streamed workshops, or specific room subscriptions marked as non-refundable at the time of purchase, are non-refundable and non-deferrable. These restrictions will be clearly indicated during registration.
- Changes to Subscriptions or Enrollments: Changes to room subscriptions, course enrollments, or workshop schedules may be accommodated based on availability, provided the request is made at least 48 hours before the scheduled start time. Change requests must be submitted via tiba@tiba.my or through the platform’s account management portal. Additional fees may apply for changes requested outside this 48-hour window, subject to the specific terms of the subscription or course.
- Cancellation Process: To cancel a subscription, enrollment, or booking, users must:
- Log into their TIBA account and navigate to the "My Subscriptions" or "My Courses" section, or
- Contact our customer service team at tiba@tiba.my with their account details and reference number.
We may request proof of identity to process cancellations securely. Users are responsible for maintaining the security of their account credentials.
5. Business Listings and Advertising
- Subscribed users may create business listings and access ad space to promote educational products or services (e.g., courses, tutoring, or resources) by subscribing to a room. By using these features, you agree to the following:
- Content Requirements: Listings and ads must be accurate, lawful, and compliant with our Community Guidelines and Advertising Policy (available on our website). Do not include misleading claims, prohibited items (e.g., illegal goods), adult content, or offensive content.
- Ad Space: Subscribed users receive ad space (e.g., banners, sponsored educational posts, or promoted listings) as part of their subscription tier. You are responsible for ensuring your ads meet applicable advertising laws, including Malaysia’s Advertising Standards if targeting Malaysian users.
- Approval Process: We reserve the right to review and approve listings and ads to ensure compliance. We may remove or reject content that violates our policies without notice.
- Liability: You are solely responsible for the content of your listings and ads, including any claims, warranties, or liabilities arising from them. We are not liable for disputes between users regarding listings or ads.
- Visibility: Ad space visibility (e.g., placement or frequency) depends on your subscription tier and platform algorithms. We do not guarantee specific results or audience reach.
6. Community Guidelines
- We are committed to fostering a respectful and inclusive educational community. These Community Guidelines outline the standards for content and conduct on TIBA to ensure a safe and productive environment for all users.
- General Conduct:
- Be respectful and inclusive in all interactions, including posts, comments, threads, and forums.
- Contribute constructively to educational discussions, sharing knowledge that aligns with TIBA’s mission to promote learning.
- Do not engage in harassment, bullying, or discriminatory behavior based on race, gender, religion, nationality, disability, sexual orientation, or any other characteristic.
- Content Standards:
- Content must be educational, accurate, and relevant to TIBA’s platform (e.g., tutorials, courses, workshops, or knowledge-sharing posts). Ensure you have the rights to share any content you post.
- Do not post or share content that includes:
- Adult content, including explicit or suggestive material.
- Hate speech, including content that promotes violence, discrimination, or hostility.
- Misleading or false information, including fraudulent claims about services or qualifications.
- Illegal content, including pirated materials or content violating intellectual property rights.
- Spam, repetitive posts, or off-topic content unrelated to educational purposes.
- Business listings and ads must comply with our Advertising Policy and be truthful, lawful, and relevant to educational services.
- Enforcement:
- We reserve the right to review, moderate, or remove content that violates these Community Guidelines or our Terms of Use without notice.
- Violations may result in warnings, content removal, account suspension, or termination, depending on the severity of the breach.
- Users may report violations or concerns to our customer service team at tiba@tiba.my.
